NODISC campaign - could BARD help us?
BARD campaigned against an eco-town in Long Marsden resulting in a High Court judge granting a judicial review of the eco-town initiative September 2008, to take place in the High Court before the end of this year, more details below.

They (BARD) have undoubtedly jumped through the same hoops we are currently negotiating and could become valued allies/advisers?

=============================

The future of Gordon Brown's eco-town policy has been brought under threat after a judge ruled that part of the project should be subject to judicial review.

Campaign group Bard (Better Accessible Responsible Development) won a case in the High Court yesterday.

The group claims the eco-town programme is "unlawful" because the public was not consulted properly on the project.

“I have no doubt that this claim is arguable and so permission should be granted," said Mr Justice Collins on granting the application.

The case will be now be subject to a full hearing at the High Court before the end of the year.

Bard was founded by residents opposed to the development of an eco-town in Long Marsden near Stratford Upon Avon.

Bard claims that if it is successful with the judicial review, the government would have to start again from scratch with proper consultation on all proposed sites.

Three of the proposed sites on the shortlist of 15 sites for eco-towns have already been scrapped after public protest.

Can't loose anything by contacting BARD Webmaster. If we are an eco-town we should have a similar case.
In addition to picking up tips about an application to the court they may also have web-based background information on the whole issue. I feel abysmally ignorant about eco-towns etc despite reading Basil's useful NODISC site.

Hey Peter,
I too find it difficult to understand the differences It seems to me to be a game of labels. I think the important thing is to try to focus on what what the results of all this are goingto be and how it impats our life. Check out his doc I found .......

http://www.leeds.gov.uk/leedscityregi/docs/lateitem_aug2008.pdf

The parts I f ound very interesting indeed are as follows:

2.4 this point clearly indicates that the government expected regional councils to enter into public consultation over the growth point proposals and analyse the long term ramifications. Clearly Skipton council failed to do this and were outed trying to hush the plans up.

3.6 This is an interesting point that indicates that the proposals may actualy be flawed legaly. Id love to know why.

6.5 There is a clear indication here that the plans are up against time on a serious level and that the public consultation can definitely be the way to hinder progress!

7.1 this point in the conclusions section names the top man in this whole plan. Lain Wright MP. Im wondering if we should write to him and explain the underhanded methods employed by his underlings?

This document is launchable on the knowledgbase page of www.NODISC.org ( growth point agenda)
